Should this be in PNG-format or do we have to use another format?

PNG and BMP are nice both.

old one is in 24bits.
have it to be in this color depth or can be in 4 , 8 , 16 or 32bits ?

for god sake! just use a lossless format(aka .png and bmp | 24bit) which can be open with the stupidest app ever: paint

paint stupidest it is can open 4,8,16or32bits depth but nds and gba are 16bits max
so it will easier and lighter if it can be in 8bits

which means it can be down sampled(or whatever it is called) from 32bit/24bit to 16, 8 or even 4bit. the users decision. just upload the highest quality(-> lossless format(png, bmp, etc.), 24bit/32bit) with the correct resolution, the rest depends on the programmer.
